What is a Statutory Will?
A Statutory Will is a Court of Protection approved Will for an individual who lacks capacity to make their own Will.
Your application for a Statutory Will will only be granted where the Court consider it is in the individual’s ‘best interests’ to make the application. We can advise you whether the application is in the individual’s best interests and the prospects of succeeding in your application.
When making the application to the Court, you will need supporting evidence to demonstrate that the Statutory Will that you are asking for is in the individual’s best interests.
