(Small) Reduction in Court of Protection Application Fees and Appeal Fees

As of the 25th July 2018, application fees to the Court of Protection will reduce from £400 to £385. Appeal fees will also be reduced from the same date from £400 to £320. A small reduction, but a welcomed one as Court of Protection costs can be costly to individuals.

It is not clear at this stage whether a refund scheme will be put in place to refund those that have paid the higher fee. A refund scheme was previously adopted by the Office of the Public Guardian for Lasting Powers of Attorney and Enduring Powers of Attorney registered between 1 April 2013 to 31 March 2017. Please follow this link to apply for a refund. You must note that refunds have to be claimed by 31 January 2021.

As noted, it is not clear whether a refund scheme will be bought in in relation to Court of Protection Fees previously paid. If such a scheme is in force, the Court of Protection Team at Coffin Mew will advise further.
