If there is an Arbitration clause in your contract, we are experienced in bringing or defending Arbitration proceedings and can help you through the process.
An Arbitration is different to Court because the parties appoint their own Judge (or Arbitrator), and will try and find an Arbitrator with relevant experience in the matter which the parties agree on. They will then direct the process and set a timetable and procedure to be followed until the matter concludes.
Arbitration has the advantage of being quicker than litigation, albeit it sometimes emulates the court process. The process is also not as quick as Adjudication.
The Arbitrator’s decision is binding and there are limited rights of appeal. Like with Adjudication, the Arbitrator’s decision can be enforced through the courts. We have experience of doing this.
