Data Protection

The Data Protection Act applies to information about people rather than businesses themselves. It sets out rules about what you can and cannot do with the information, how you obtain it, store it and maintain it and how safe you must keep it. These rules apply whether or not your business has registered, or is exempt from registration, with the Information Commissioner’s Office.

To be covered by the Act, the information must relate to a living individual and must be capable of being used to identify that person. This includes anonymous information which can be mapped with other information to identify a living person. Even where a business has lawfully collected personal information, it may be subject to data access requests which allow individuals to obtain information held about them. There are strict obligations and timetables in relation to such requests which need to be adhered to.

In May 2018, and regardless of Brexit looming, the Data Protection Act will be replaced with the new General Data Protection Regulation. The rules on obtaining consent and responding to Subject Access Requests among many others, are being tightened up. We are currently working with clients now, reviewing how they collect and hold personal data and helping them review their operations to ensure they are compliant with the new rules by next year.
